Brazil resumes anti-dumping duty on PVC resin to China

On September 27, 2021, the Management Executive Committee (gecex) of the Foreign Trade Commission of the Ministry of economy of Brazil issued Resolution No. 255 of 2021, which decided to resume the imposition of anti-dumping duty on PVC resin originating in China [Portuguese: reinade polycloretodevinila obtida por processo de suspends ã o (pvc-s)] for a period of five years, with a tax rate of 21.6%. The tax number of the product involved in the case is 3904.10.10. The resolution shall come into force as of the date of promulgation.

On September 21, 2007, Brazil launched an anti-dumping investigation on PVC resin originating in China and South Korea. On August 29, 2013, Brazil filed its first sunset anti-dumping review investigation on PVC resins originating in China and South Korea. On August 15, 2019, the Ministry of economy of Brazil issued announcement No. 50 of 2019, initiating the second sunset review investigation of anti-dumping on PVC resin originating in China and South Korea at the application submitted by Brazilian enterprise Braskem S.A.

On March 6, 2020, the Brazilian Foreign Trade Secretariat issued announcement No. 14 of 2020, making a positive preliminary determination of the second anti-dumping sunset review on PVC resin originating in China and a negative preliminary determination of the second anti-dumping sunset review on products involved in South Korea.

On August 14, 2020, the Management Executive Committee (gecex) of the Foreign Trade Commission of the Ministry of economy of Brazil issued Resolution No. 73 of 2020, making a positive and final determination of the second sunset anti-dumping review on PVC resin originating in China, and decided to continue to impose anti-dumping duties on the products involved in China for a period of five years. The enterprise involved in the case was Shanghai Chlor Alkali Chemical Co., Ltd Shanghai Chlorine Alkali Chemical Co., Ltd., Suzhou HuaSu Plastics Co., Ltd., Tianjin Dagu Chemical Co., Ltd., Tianjin LG Dagu Chemical Co., Ltd The anti-dumping duties of and other Chinese enterprises were 21.6%. Due to doubts about the future import trend of the products involved, the anti-dumping duties will not be levied for the time being.
